This fall, the American Arbitration Association® (AAA) will present a program that will look at how -- with a greater understanding of the Labor Arbitrator’s Code of Professional Responsibility -- advocates can increase their effectiveness in representing clients during labor-management disputes.
The panel of presenters, which will be comprised of arbitrators and advocates, will explore the guidelines outlined in the Code and discuss with attendees how they apply to the arbitration process and arbitrator responsibilities.
Areas to be covered include:
• Ethical issues concerning third party impartiality
• Conducting ex parte hearings
• Authorizing an arbitrator to mediate a dispute
• Using assistants to prepare decisions
• Issuing consent awards
• Billing practices of arbitrators
• Interactions between arbitrators and administrative agencies that process arbitrations
• Pre-hearing conduct by arbitrators
• Conducting site visits, issuing bench decisions and using transcripts
The program also will include mock case scenarios where the presenters, along with an AAA® case administrator will provide perspectives on addressing violations of the Code of Ethics.
CLE:
The program is approved in New York State for 2 transitional/non-transitional CLE credit hours (2 Ethics). New York State Scholarship is available upon request.
